Agreement
These Terms of Service (“Terms”) are a legal agreement between you and [YOUR LEGAL ENTITY NAME, e.g. True Talk LLC] (“True Talk,” “we,” “us”), governing your access to and use of the True Talk mobile application, the website at TrueTalkApp.com, and the games True Talk, Can We Go Deeper, and Love Dice (collectively, the “Services”).
Please read these Terms carefully. By creating an account, downloading, installing, or using the Services, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Services.
Eligibility
- You must be at least 18 years old to use the Services. By using True Talk, you represent and warrant that you are 18 or older.
- You must not be located in a country subject to a U.S. Government embargo, or designated by the U.S. Government as a “terrorist supporting” country, or be on any U.S. Government list of prohibited or restricted parties.
- You agree to comply with all applicable laws when using the Services.
Your Account
- You’re responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
- One account per person. You may not let anyone else use your account, and you may not use anyone else’s.
- The information you give us must be accurate and current. Notify us promptly of any unauthorized use of your account.
- We may refuse, suspend, or terminate accounts at our discretion if we reasonably believe these Terms are being violated.
Acceptable Use
When using the Services, you agree not to:
- Use the Services in any way that violates any applicable law, regulation, or third-party rights.
- Harass, threaten, stalk, defame, or abuse anyone, on or off the App.
- Use the Services to coerce, manipulate, or pressure another person to share, perform, or consent to anything they do not freely choose.
- Reverse engineer, decompile, scrape, or attempt to extract source code or training data from the App or AI Advisor.
- Probe, attack, or interfere with the security or integrity of our systems.
- Upload or transmit malware, spam, or harmful code.
- Impersonate any person or entity or misrepresent your affiliation.
- Use bots, scripts, or automated tools to interact with the Services without our written permission.
- Resell, sublicense, or commercially exploit the Services without our written permission.
- Use the Services to generate, distribute, or solicit content that sexually exploits or abuses minors, promotes violence or discrimination, or violates the law.
Game Content & Conduct
Our games provide prompts, questions, dares, and dice rolls designed to spark conversation, vulnerability, and connection. How you choose to use them is your responsibility. True Talk is for entertainment and connection — you and the people you play with are responsible for treating each other with respect, honoring “pass” or “skip” at all times, and for any actions taken in response to a prompt. The AI Advisor — Important Disclaimer
The AI Advisor is an optional feature that uses third-party large-language models to generate responses. It is provided for entertainment and reflective conversation only. The AI Advisor:
- is not a licensed therapist, counselor, doctor, lawyer, or financial advisor;
- does not provide medical, mental-health, legal, or financial advice;
- may produce inaccurate, incomplete, or inappropriate output — you should not rely on it to make important decisions; and
- should never be used as a substitute for professional help.
If you are in crisis or experiencing serious emotional distress, please contact a qualified professional or one of the resources listed in our Safety Guidelines.
Subscriptions, Purchases, and Refunds
Some features of the Services may be offered as one-time purchases or recurring subscriptions through the Apple App Store or Google Play. Pricing, billing, renewal, and cancellation are handled by the applicable app store under its own terms. Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current period.
To cancel a subscription, manage it in your Apple ID or Google Play account settings. Refund requests are governed by Apple’s and Google’s policies and must be made through them. True Talk cannot directly issue refunds for app store purchases. For other questions, contact support@truetalkapp.com.
Intellectual Property
The Services and all content, features, code, design, prompts, illustrations, trademarks, logos, and other materials (the “True Talk Content”) are owned by True Talk or our licensors and are protected by copyright, trademark, and other intellectual-property laws.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Services for your own non-commercial enjoyment in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works of any True Talk Content without our prior written permission, except as expressly allowed by these Terms or applicable law.
Your Feedback
If you send us feedback, suggestions, or ideas, you grant us a worldwide, royalty-free, perpetual, irrevocable license to use them for any purpose without obligation to you. Don’t send us anything you consider confidential or proprietary.
Termination
You may stop using the Services or delete your account at any time. We may suspend or terminate your access to the Services if you violate these Terms, if we’re required to by law, or if continuing to provide the Services becomes commercially impractical. Sections that by their nature should survive termination (Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, General Provisions) will survive.
Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TRUE TALK DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
We do not warrant that the Services will be uninterrupted, secure, error-free, or that any information (including AI Advisor output) is accurate, complete, or appropriate for your situation. You use the Services at your own discretion and risk.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRUE TALK AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability for all claims arising out of or related to the Services in any twelve-month period will not exceed the greater of (a) the amount you paid us during that period, or (b) one hundred U.S. dollars (US $100). Some jurisdictions don’t allow these limits, so they may not apply to you in full.
Indemnification
You agree to indemnify and hold harmless True Talk and its officers, directors, employees, and agents from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your violation of any rights of another person.
Apple App Store Additional Terms
If you obtain the App from the Apple App Store, the following additional terms apply (Apple requires us to include them):
- These Terms are between you and True Talk only, not with Apple. Apple is not responsible for the App or its content.
- The license we grant you is limited to use of the App on Apple-branded products you own or control, in accordance with the Usage Rules in the App Store Terms of Service.
- If the App fails to conform to any applicable warranty, you may notify Apple, who will refund your purchase price; Apple has no other warranty obligation.
- Product and warranty claims, intellectual-property claims, and product-liability claims are our responsibility, not Apple’s.
- You represent that you are not in a U.S.-embargoed country and not on any U.S. Government list of prohibited parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play Additional Terms
If you obtain the App from Google Play, you also agree to comply with the Google Play Terms of Service. Google is not a party to these Terms and is not responsible for the App.
Governing Law
These Terms are governed by the laws of the State of [YOUR STATE, e.g. Texas], USA, without regard to its conflict-of-laws principles. Any dispute that is not resolved through the process below will be brought exclusively in the state or federal courts located in [YOUR COUNTY, STATE], and you and we consent to personal jurisdiction there. (If you are a consumer in the EU/UK, your local mandatory consumer protections still apply.)
Dispute Resolution
Most concerns can be resolved quickly. Please email us at legal@truetalkapp.com first, with the details of your dispute. We’ll work in good faith to resolve it within 60 days. If we can’t, either party may pursue the matter in the courts identified above.
Changes to These Terms
We may update these Terms from time to time. When we do, we’ll change the “Last updated” date at the top, and for material changes we’ll provide notice in the App or by email at least 14 days before they take effect. Your continued use of the Services after changes take effect means you accept the updated Terms. If you don’t accept them, please stop using the Services and delete your account.
General Provisions
- Entire Agreement. These Terms (together with the Privacy Policy and any additional terms we provide for specific features) are the entire agreement between you and us regarding the Services.
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
- No Waiver. Our failure to enforce any right or provision is not a waiver of that right.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- No Agency. No partnership, joint venture, employment, or agency relationship is created by these Terms.
- Force Majeure. Neither party is liable for failures or delays caused by events beyond reasonable control (natural disasters, internet outages, government actions, etc.).
